Mountain guide / ski guide - Mountain guide / ski guide - Recognition of qualifications

General information

Foreign certificates of competence and qualification may be recognised by the competent authority.

The  professional qualifications of applicants who  hold a certificate of competence or a certificate of education and training shall - upon application - be recognised as meeting the requirements for admission to the same profession laid down by provincial law if the certificate of competence or certificate of education and training:

  • is issued by the competent authority of their home Member State and;
  • is required in the home Member State to obtain authorisation to take up and pursue that profession in its territory.

If starting or pursuing a profession is not regulated in the country of origin, the applicant's professional qualification will be recognised upon application if the applicant has pursued that profession full-time in that Member State for 1 year or part-time for the equivalent period in the preceding 10 years, provided that they hold one or more qualifications which:

  • are issued by the competent authority of their home Member State and;
  • certify that the holder has been prepared for the practice of the profession concerned.

Compensatory measures may then be required where:

  • the training in the profession concerned relates to subjects that differ substantially in content from those regulated under provincial legislation governing the profession in question, or;
  • the profession is regulated according to the particular provincial legislation and includes one or more regulated activities that are not part of the professional description according to the legislation of the applicant's country of origin and the required training relates to subjects that differ substantially in content from the applicant's training.

The legal basis for the recognition of professional qualifications are Sections 9 et seq. of the Styrian Law on the Recognition of Professional Qualifications  (StBRG 2020).

Note: alternatively, your Member State of origin can provide recognition  by means of the European Professional Card (EPC).

Means of redress or appeal

An appeal is possible against rulings issued by an authority and shall be filed by the party within a 4 weeks term with the authority that issued the ruling of first instance (against rulings without investigation procedure within a two weeks term). The term starts with the receipt of the written copy of the ruling, in the case of oral pronouncement simultaneously with it.

The appeal shall indicate the ruling it contests, the authority that issued the ruling and contain a motion of appeal with the reasons. No more appeal is admissible if the party expressly waived the right of appeal after receipt or pronouncement of the ruling.

Each ruling contains instructions on the right to appeal and indicates the authority and the deadline for submission of such appeal.
